TERMS
Terms of Service
1. Acceptance of these terms
These Terms of Service govern your use of the website operated by DevOps Crowd Inc. By accessing or using the website, you agree to be bound by these terms and by our Privacy Policy. If you do not agree, please do not use the website. Effective date: 16 June 2026. (Placeholder. The founder should confirm this date before publication.) We may update these terms from time to time, as described below.
2. About the website
DevOps Crowd Inc. is a software engineering studio based in Montreal, Quebec, Canada. This website is informational only. It describes who we are and the kinds of work we do, and it lets you contact us or book a call. It has no user accounts and no product login, and any prices or descriptions shown are general information, not a personalized quote.
3. No offer, and paid services are governed by a separate agreement
Nothing on this website is an offer to enter into a contract, and nothing here creates a binding agreement between you and us. The actual services we provide to clients, including their scope, deliverables, timelines, fees, warranties, and other terms, are governed exclusively by a separate written agreement and statement of work signed by both parties for each engagement. If there is any conflict between this website and a signed agreement, the signed agreement governs the services it covers.
4. Eligibility
You may use this website only if you are able to form a binding agreement and are not barred from doing so under applicable law. The website is intended for businesses and professionals, and you confirm that you use it for those purposes and not on behalf of a child.
5. Acceptable use
You agree to use the website lawfully and in good faith. You agree not to interfere with or disrupt the website or the servers and networks that support it, not to attempt to gain unauthorized access to any part of it, not to introduce malicious code, not to scrape, harvest, or collect information about other users, not to misuse the contact form, for example by sending unsolicited, unlawful, or abusive content, and not to use the website in any way that infringes the rights of others or violates any applicable law. We may suspend or restrict access to the website if we reasonably believe these terms are being breached.
6. Intellectual property and trademarks
The website and its content, including text, graphics, layout, design, images, and code, are owned by DevOps Crowd Inc. or used under license, and are protected by intellectual property laws. The DevOps Crowd name, the DevOps Crowd logo, and other brand elements are our trademarks and may not be used without our prior written permission. We grant you a limited, personal, non exclusive, and revocable right to view and use the website for your own informational and business evaluation purposes. You may not copy, reproduce, modify, distribute, or create derivative works from the website or its content except as expressly permitted or as allowed by law.
7. Third party links
The website may contain links to third party websites or resources that we do not own or control. We provide these links for convenience only. We do not endorse and are not responsible for the content, products, services, or privacy practices of any third party site, and your use of those sites is at your own risk and subject to their own terms.
8. No warranties
The website is provided on an as is and as available basis. To the fullest extent permitted by law, we make no warranties or representations of any kind, whether express, implied, or statutory, about the website, including any implied warranties of merchantability, fitness for a particular purpose, title, and non infringement. We do not warrant that the website will be uninterrupted, timely, secure, or error free, that any information on it is accurate, complete, or current, or that it will meet your requirements. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
9. Limitation of liability
To the fullest extent permitted by law, DevOps Crowd Inc. and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your access to or use of, or your inability to access or use, the website, even if we have been advised of the possibility of such damages. Our total aggregate liability arising out of or related to the website is limited to one hundred Canadian dollars. Nothing in these terms limits any liability that cannot be limited or excluded under applicable law. This section does not affect liability under a signed services agreement, which is governed by that agreement.
10. Indemnification
You agree to indemnify and hold harmless DevOps Crowd Inc. and its directors, officers, employees, and agents from and against any reasonable claims, damages, and expenses, including reasonable legal fees, that arise out of your unlawful use of the website or your breach of these terms. This obligation is limited to matters caused by your own acts or omissions and does not apply to the extent a claim results from our own conduct.
11. Privacy
Our collection and use of personal information through the website is described in our Privacy Policy, which forms part of these terms. By using the website, you acknowledge that you have read the Privacy Policy.
12. Changes to the website and to these terms
We may change, suspend, or discontinue any part of the website at any time without notice, and we may update these terms from time to time. When we make a material change to these terms, we will update the effective date above and, where appropriate, provide a more prominent notice. Your continued use of the website after a change takes effect means you accept the updated terms.
13. Governing law and dispute resolution
These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable in that province, without regard to conflict of laws rules. You agree that any dispute arising out of or relating to these terms or the website will be subject to the exclusive jurisdiction of the courts of the Province of Quebec, sitting in the judicial district of Montreal, and you consent to the jurisdiction of those courts. Nothing in this section affects any mandatory rights you may have under the law of your place of residence.
